Article 10

            Attendance and Leave

            §10.1 Holiday Scheduling
               (a) Assignment of holiday time off shall be made at the times desired by

            an employee to the extent practicable in the light of needs of the department
            or institution involved to provide the service it is charged to provide. In the

            event that more employees request the same holiday time off than can be
            reasonably spared for operating reasons, holiday time off will be granted

            to such employees who can reasonably be spared, in order of seniority as
            de fined in the Seniority Article of this Agreement.

               (b) To assist in the scheduling of such holiday time off, departments,
            agencies, institutions or other local operating units may establish dates or

            periods before each holiday by which or within which an employee must
            request specific  holiday time off in order  to have his or her seniority

            considered.
               (c)  Establishment of such dates or periods shall be worked  out  in

            understandings between such departments, agencies, institutions or other
            local operating units and the appropriate designee of CSEA unless they

            mutually agree that such dates or periods are unnecessary or undesirable.
            Failing agreement on establishing or not establishing such dates or periods,

            the establishment of such dates or periods shall be referred by CSEA or the
            State to a committee composed of designees of the President of CSEA and

            the Director of  the Governor’s  Office of Employee Relations for the
            establishment of such dates  or periods for  the department,  agency,

            institution or other local operating unit involved.
            §10.2 Holiday Time

               (a) An employee who is entitled to time off with pay on days observed as
            holidays by the State as an employer shall be granted compensatory time

            off when any such holiday falls  on a Saturday or pass day; provided,

            however, that employees scheduled or directed to work on any such
            Saturday or pass day may receive additional compensation in lieu of such
            compensatory time off in accordance with Article 7.16 of this Agreement.

            The State may designate a day to be observed as a holiday in lieu of such

            holiday which falls on Saturday or a pass day.
               (b) Compensatory time off in lieu of holidays earned after the effective

            date of this Agreement shall be recorded  in  a  separate leave category
