three  person panel to hear and decide upon appeals from ratings of

         “Unsatisfactory.” One member is to be  selected  by the Director  of the

         Governor’s  Office of Employee Relations; a second  member will  be
         selected  by  the  Statewide  President  of  CSEA;  the  third  will  be  jointly

         agreed upon by both the Director of the Governor’s Office of Employee
         Relations and the President of the CSEA.

            §40.3  The State shall prepare,  secure introduction, and recommend
         passage by the  Legislature  of such legislation required  to provide for

         appropriations  in the amount indicated in each year of  the 2016-2021
         Agreement: $43,509 in 2016-2017, $44,379 in  2017-2018, $45,267 in

         2018-2019, $46,172 in 2019-2020, and $47,096 in 2020-2021 for
         administrative expenses associated with the Statewide Performance Rating

         Committee activities.


         Article 41
         Departmental Negotiations

            (a)  The  provisions of any agreements negotiated pursuant to the
         provisions of Article 28 of the 1970-72 State/CSEA Agreements, Article

         29 of the 1972-73 State/CSEA Agreements and Article 32 of the 1973-76
         State/CSEA Agreements  for the Administrative, Institutional and

         Operational Services Units, are the only agreements covered  by the
         provisions of this Article.

            Any provision of the aforementioned departmental agreements which has
         been superseded by subsequent negotiations or any State/ CSEA Collective

         Bargaining Agreement shall be considered void effective April 1, 1988.

         Any provision  not superseded shall continue for the  term of this
         Agreement.
            (b) During the first year of the Agreement the State and CSEA, at the

         departmental level, may meet to discuss continuation or elimination of any

         provisions  that are not superseded. Any adjustment must be by  mutual
         agreement.


         Article 42

         Accidental Death Benefit
            §42.1 In the event an employee dies subsequent to April 1, 1985, as the

         result of an accidental on-the-job injury and a death benefit is paid pursuant
