credits below 40 days are once again subject to the 40-day maximum. They
can again exceed that maximum only following denial of a request under
the conditions described above. Any vacation credits in excess of 40 days
on March 31 are forfeited.
Vacation Anniversary Date
The vacation anniversary date is ordinarily the date of appointment to
State service. The vacation anniversary date is not altered by leaves without
pay or separations from State service of less than six months’ duration.
However, the vacation anniversary date is adjusted whenever the
employee is on leave without pay for more than six months or is separated
from State service for a period of six to twelve months. The vacation
anniversary date is adjusted by adding the number of months and days off
the payroll due to leave without pay or separa- tion to the original vacation
anniversary date.
Generally, persons reemployed after a separation from State service
which exceeds one year are treated as new employees and are assigned a
new vacation anniversary date.
Use of Vacation
Section 10.4 of the ISU Agreement contains a discussion of the impact
of seniority on scheduling of vacations and describes procedures for local
arrangements establishing annual periods within which employees must
request a block of time off in order to have seniority considered. For
Section 10.4 a block of time is defined as five or more consecutive work
days.
Section 10.12 provides additionally that, apart from other arrangements
developed in accordance with this section, an employee’s properly
submitted written request for use of accrued vacation credits must be
answered in writing within four days of its receipt and establishes
procedures to ensure a timely response within two days thereafter. This
section also confirms that vacation scheduling is an appropriate subject for
labor/management discussions.
Separation
Employees who separate from State service may be eligible for a lump
sum payment for up to 30 days of accrued and unused vacation.
